Smoking on Costa Blanca Beaches: What Spain’s Proposed New Smoking Ban Means for Tourists

Spain is preparing one of the biggest changes to its smoking laws in decades. Headlines around the world have claimed that smoking has already been banned on Spanish beaches, but that isn’t actually the case. Here’s what travellers to the Costa Blanca really need to know.

No, Spain Has Not Yet Banned Smoking on All Beaches

Over the past few days, many international news outlets and social media posts have reported that Spain has banned smoking on its beaches. While the headlines sound dramatic, they are not entirely accurate.

The Spanish Council of Ministers has approved a draft anti-smoking law, but it has not yet become law. Before the new rules can take effect, the legislation must still be debated and approved by both chambers of the Spanish Parliament. During that process, amendments may be introduced before the final version is published in the Official State Gazette (BOE).

For now, existing regulations remain in force.

What Would Change Under the New Law?

If Parliament approves the proposal, Spain would significantly expand its smoke-free areas.

The proposed restrictions would prohibit smoking and vaping in locations including:

  • Beaches
  • Bar and restaurant terraces
  • Public swimming pools
  • Outdoor sports facilities
  • University campuses
  • Bus shelters
  • Outdoor event venues
  • Around schools and healthcare centres
  • Within approximately 15 metres of many public building entrances

Perhaps the biggest change is that vaping would no longer be treated differently from traditional smoking. Electronic cigarettes, heated tobacco products and many nicotine devices would all be subject to the same restrictions.

Why Is Spain Introducing These Measures?

According to Spain’s Ministry of Health, the objective is to better protect the public from second-hand smoke while also addressing the rapid rise in vaping among young people.

Health officials estimate that smoking contributes to around 50,000 deaths every year in Spain, making tobacco one of the country’s leading preventable health risks. The government believes expanding smoke-free public spaces is an important step in reducing exposure and discouraging smoking among future generations.

What Does This Mean for Costa Blanca?

For many visitors, the announcement changes less than they might expect.

Several municipalities along the Costa Blanca have already introduced their own smoke-free beach policies over the past few years as part of the “Playas Sin Humo” (Smoke-Free Beaches) initiative.

Depending on where you spend your holiday, you may already find beaches where smoking is prohibited or only allowed in designated areas.

This means that some Costa Blanca visitors have already been experiencing smoke-free beaches long before the proposed national legislation.

Because these local rules are introduced by individual municipalities, they can vary considerably from one town to another.

Costa Blanca Visitors Should Always Check Local Beach Rules

If you’re visiting destinations such as:

  • Alicante
  • Benidorm
  • Altea
  • El Campello
  • Villajoyosa
  • Santa Pola
  • Torrevieja
  • Dénia
  • Jávea (Xàbia)
  • Calpe

it’s always worth checking the information boards located at beach entrances.

Many beaches display signs indicating whether smoking is permitted, restricted or completely prohibited. Local councils may also update these rules before any future national legislation comes into force.

Is Smoking Currently Banned on Costa Blanca Beaches?

Not everywhere.

There is currently no nationwide ban covering every beach in Spain.

Instead, the situation depends on local municipal regulations.

Some beaches have already become smoke-free through local initiatives, while others continue to allow smoking under existing rules.

That’s why visitors should avoid assuming that the same regulations apply across the entire Costa Blanca.

When Could the New Rules Come Into Effect?

At the moment, there is no confirmed implementation date.

The draft law must first pass through Parliament, where political negotiations and amendments are expected. Only after final approval will it be published in Spain’s Official State Gazette (BOE), which will specify when the new regulations become legally enforceable.

Realistically, the process could take several months and potentially longer if parliamentary debates delay approval.

What Should Tourists Do Right Now?

For now, nothing changes for most visitors.

If you’re planning a holiday on the Costa Blanca this summer or later this year:

  • Continue following existing local beach rules.
  • Check beach signage before smoking or vaping.
  • Respect designated smoke-free areas.
  • Be aware that regulations may change in the coming months if Parliament approves the new law.

What Visitors Should Remember

Spain is moving towards some of the strictest anti-smoking regulations in Europe, but the proposed legislation has not yet become law.

For Costa Blanca visitors, the biggest takeaway is that many beaches are already smoke-free under local regulations, while others are not. Until Parliament completes the legislative process, tourists should continue following the rules displayed at each individual beach.

Should the law receive final approval, smoking and vaping habits on beaches, terraces and many public spaces across Spain could change significantly, making this one of the country’s most important public health reforms in more than a decade.
